Sales Policy
1. Scope of application
1.1 These general terms and conditions of sale apply to orders for products placed by email, mobile phone, or online with CAILLOUX STUDIO since May 1, 2021. By placing an order with CAILLOUX STUDIO, the buyer accepts these general terms and conditions.
2. Order
2.1 Each item is designed and handmade by Kim Wyss. Ceramic pieces must be handled with care.
2.2 Each piece is unique, even if they come from the same series. During production, shapes, colors, and dimensions may vary slightly. By purchasing a CAILLOUX STUDIO product, the buyer is aware that the product is handmade and accepts that it may have slight imperfections that do not affect its use. However, we ensure that these are kept to a minimum.
3. Conclusion of the contract
3.1 CAILLOUX STUDIO accepts no responsibility for the fact that an ordered item can no longer be delivered due to lack of available stock, additional supply, or production.
3.2 Orders placed on www.caillouxstudio.com will be accepted while stocks last. The order is final upon confirmation of purchase. The sales contract is deemed to be concluded at the time of order confirmation.
3.3 Under no circumstances may the buyer modify or cancel an order when they have ordered items that have been manufactured and/or customized at their request, or when the items ordered are already in the process of being delivered.
4. Retention of title
4.1 CAILLOUX STUDIO retains ownership of the goods sold and delivered until the purchase price has been paid in full. Furthermore, no reproduction of the works is permitted, either before or after the purchase of the item.
5. Prices
5.1 The sale prices of the products are indicated in Swiss francs (CHF) and include any discounts applicable on the day of the order.
5.2 The sale prices do not include delivery costs. The amount of the delivery costs is added to the sale price and is indicated in the order summary (“shopping cart”).
5.3 CAILLOUX STUDIO reserves the right to change prices freely and at any time. The price in effect is the price displayed at the time of purchase.
6. Resellers
6.1 The buyer may resell the goods purchased as part of their commercial activity only if CAILLOUX STUDIO has given its consent. A request must be made to hello@caillouxstudio.com.
6.2 Once the terms have been discussed between CAILLOUX STUDIO and the reseller, the latter undertakes to provide, upon request, a detailed statement of sales and to pay CAILLOUX STUDIO the amount due. The reseller also undertakes to communicate any price changes before they are applied.

7. Shipping costs
7.1 Shipping and handling fees vary depending on the product.
7.2 When ordering multiple items, shipping costs are calculated based on the total volume and weight.
7.3 All items are sent by Swiss Post as B Mail and invoiced accordingly.
8. Delivery time
8.1 The delivery (shipping) time for items in stock at the time of purchase is 3 to 10 business days from receipt of payment.
8.2 The delivery times indicated in these Terms and Conditions are for information purposes only. They are not binding. The buyer is required to accept any delivery of products, even if the delivery is received after the indicated delivery time.

9. Delivery
9.1 All orders can be picked up directly from the workshop in Biel/Bienne by appointment.
9.2 Depending on the goods, deliveries are made by Swiss Post via B Mail from Monday to Friday.
9.3 When confirming the order, the buyer is solely responsible for the accuracy of the contact details provided. CAILLOUX STUDIO shall not be held liable for any errors in the customer's contact details that may prevent delivery of the product.
9.4 If a product is not delivered or is incomplete, the buyer has a maximum of one month (after the delivery date) to report this. After this period, no claims will be accepted.
10. Transfer of risk
10.1 The transfer of risk—which includes the risk of loss and damage to the goods—passes to the buyer upon receipt of the goods.
10.2 If the buyer does not take possession of the goods, the transfer of risk passes to the buyer at the time the goods are returned to CAILLOUX STUDIO.
10.3 If the buyer returns goods to CAILLOUX STUDIO, the buyer bears the risk until the goods are received by CAILLOUX STUDIO.

11. Return or exchange policy
11.1 Items delivered by CAILLOUX STUDIO may be returned within 14 days of receipt of delivery.
11.2 Returned items must be intact and complete, in their original packaging.
11.3 Custom-made or personalized items cannot be returned or exchanged under any circumstances.
11.4 Return shipping costs are the responsibility of the buyer.
12. Payment
12.1 Payment for goods can be made by credit card (Visa, Mastercard) via the online shop or Twint if the item is collected in person from the workshop.
12.2 CAILLOUX STUDIO may, at its sole discretion, impose a payment method on the buyer or refuse to enter into a contract with them.
12.3 Regardless of the payment method used, the buyer understands and accepts that their payment may be processed by a financial intermediary subject to legal obligations regarding money laundering.
12.4 Items are reserved for a maximum of 10 days. After this period, if no payment has been received by CAILLOUX STUDIO, they will be put back on sale.
12.5 In the case of payment by credit card, the buyer's credit card will be debited at the time of ordering. If an item is out of stock or canceled, CAILLOUX STUDIO will refund the buyer on their card.
12.6 CAILLOUX STUDIO is in no way responsible for any charges related to a debit.
12.7 The use of a credit card is exclusively reserved for purchases made via the website. Orders placed by email (custom or personalized orders) do not allow the use of a credit card.
13. Product inspection
13.1 If the product is damaged upon receipt of the package, the buyer must notify us of any claims within 48 hours of receipt at hello@caillouxstudio.com. The money-back guarantee can only be applied if a written request is made, stating the reasons for the return and accompanied by photographic evidence.
13.2 In the absence of notification from the buyer within the aforementioned period, the products are deemed to have been received in good condition, without defects or damage, and accepted as is, with the exception of hidden defects.

15. Applicable law and place of jurisdiction
15.1 The place of jurisdiction is the registered office of CAILLOUX STUDIO in Péry as of October 1, 2025.
In the event of a dispute, Swiss law shall apply.
